Information on the processing of personal data
according to Art. 13 General Data Protection Regulation (GDPR)

Dear Sir or Madam,

For the purpose of processing your inquiries and for introducing our company or in order to perform contractual relationships we are required to process your personal data. Therefore, we would like to give you the following information about the processing of these data in line with the requirements set forth in the GDPR.

bio.logis digital heath GmbH acts as a “data controller” in its function of a principal (according to Art. 4 Para. 7 GDPR) as well as a “processor” in its function of a contractor (according to Art. 4 Para. 8 GDPR).

Which data are being processed?

We collect the following information to implement a contractual relationship:

  • title, first name, last name;
  • a valid e-mail address;
  • address;
  • phone number (landline and/or cell phone);
  • if necessary, further information needed to process your inquiry or fulfill contractual obligations.

Purpose of data processing

We collect and process your personal data in order to

  • identify you;
  • communicate with you;
  • process your inquiries;
  • fulfill our contractual obligations;
  • send you invoices;
  • provide information about our products and services;

Legal basis of data processing

If you are in a contractual relationship with us, the processing of your data for the purposes specified above is based on Art. 6 Para. 1 Sent. 1 lit b GDPR and is required to fulfill mutual contractual obligations.

If you are not in a contractual relationship with us, the processing of your data for the purposes specified above is based either on your consent according to Art. 6 Para. 1 S. 1 lit a GDPR or on our legitimate interest according to Art. 6 Para. 1 S. 1 lit f GDPR to inform you about our products and services.

How long will your data be stored?

Your personal data will be stored for the period required to process your inquiry or if applicable to maintain a resulting business relationship and will be deleted afterwards. A storage of your personal data beyond this time period is only legitimate if we are under legal obligations to keep your data (Art. 6 Para 1 S. 1 Lit c GDPR), if your data is necessary to establish, exercise or defend legal claims (Art. 17 Abs. 3 lit. e GDPR) or if you have consented to a storage of your personal data beyond the time period outlined above.

Are your data forwarded to third parties?

We are processing your personal data within a CRM system. We have a data processing agreement with the provider of this CRM system which guarantees, that your data will be processed exclusively in the EU and that the provider cannot use your data for own purposes or transfer it to third parties.

Apart from that, your personal data are not forwarded to third parties, unless the following exceptions apply:

  • you have given us your express consent;
  • it is required to fulfill contractual obligations;
  • there is a legal obligation to do so;
  • forwarding your data is necessary to establish, exercise or defend legal claims and there is no reason to believe that you have a legitimate overriding interest worthy of protection in the non-disclosure of your data;

The third party may use the forwarded data exclusively for the purposes mentioned above.

What are your rights concerning your personal data?

You have the right to:

  • withdraw your consent you gave us regarding the processing of your data at any time, provided that processing was based on consent (according to Art. 7 Para 3 GDPR). As a result, we are no longer allowed to continue with data processing based on that consent;
  • request information about your personal data which we have processed (according to Art. 15 GDPR);
  • request the immediate correction of inaccurate personal data as well as the completion of your incomplete personal data (as per Art. 16 GDPR);
  • request from us the deletion of your personal data, provided processing is not necessary to exercise the right to freedom of speech and information, for compliance with a legal obligation, for reasons of public interest, or to establish, exercise or defend legal claims (according to Art. 17 GDPR);
  • request from us the limitation of processing your personal data in the following cases (according to Art. 18 GDPR): (a) the accuracy of the personal data is contested by you; (b) processing is unlawful but you refuse to have them deleted; (c) we no longer need the data but you need them to establish, exercise or defend legal claims; or (d) you have objected to processing pursuant to Art. 21 GDPR;
  • receive the personal data you provided us, in a structured, commonly used and machine-readable format, or to transmit those data to another controller (according to Art. 20 GDPR);
  • lodge a complaint with a supervisory authority. Usually, you can contact the supervisory authority of your habitual residence or our registered office (according Art. 77 GDPR).

Your right to object

If your personal data have been processed based on legitimate interests according to Art. 6 Para. 1 Sent. 1 lit. f GDPR, you have the right to object at any time according to Art 21 GDPR, on grounds relating to your particular situation, to the processing of your personal data. Where personal data are processed for direct marketing purposes the right to object applies without restriction.
